Question re sync usage
      #1006855 - 03/09/12 10:53 PM
Hi, I understand that a track that I co-wrote (50%) will be used very soon in an online ad campaign. Am I right in thinking that I should be getting 1/4 of the sync fee bearing this in mind?

You'd know more about this than me, but I understood that the label/owners of the master recording would get 50% with the other 50% being split between the writers (2 in this case).

In the absence of an agreement to the contrary, you are correct. Sync fees comprise 2 elements - master usage and composition. Under 'Most Favoured Nation' terms, these are usually equal i.e 50% of the fee relates to the master and 50% to the composition. It follows, therefore, that, as an equal co-writer, you would be entitled to half the composition element which would be 25% of the total under MFN.

However, as BM alludes to, this is dependent on the exact terms of the license and the terms under which the label recorded the works.

yeh I guess .. not sure .. I only license direct or via publishers ..
Not labels .. the publishers also sign the recording, in my case .. but does your label sign the publishing ?

Having not really licensed for sync via labels myself, can't really say - other than - do u have a contract ? and Phil O's advice seems suitable ..
