At the end he says there's not much to worry about! Seems like a case covering their backs with the wording to me. MPEG-LA hold licenses to many other codecs too, one would think that if it were really as big an issue as your link states, it'd affect the whole list:

Probably - although in relation to the current SOS, that article does say that: "An H.264 license would be needed, though, for a band making and selling its own concert video disc"...
